Dear Council
I am writing to strongly object to the application by the Huskisson Hotel to extend the operating hours. The Hotel has been the focus of community frustration due to excessive noise and ongoing issues with patrons under the influence for a number of years with no satisfactory outcome. I did think that this had been resolved to reflect the strong opposition of the community to this proposal. Shoalhaven Council continues to promote Huskisson as a family friend destination and yet we now have 3 Hotels along Owen Street with many more licenced premises spilling patrons onto Owen Street late at night. Extension of operating hours will negatively impact residents through patrons walking through the streets ( no public transport) and increase risk of anti social behaviour. As a resident of Owen Street I urge you to not approve this application.

PROPOSAL: S4.55(2) to DA19/1354 - Change of hours of operation for the
“Beer Garden” at the Huskisson Hotel, Huskisson

The current approved hours of operation for both the “Beer Garden” and the “Waterfront Bar”
are 7.00am to 11.30pm Monday to Saturday and 7.00am to 10.00pm Sundays. It is the proposal to change the hours of operation (closing time) for both the “Beer Garden” and the “Waterfront Bar” and should not be granted as there is a documented history of non‑compliance, including breaches of existing trading hour conditions and noise limits. This history must be given significant weight under s4.55 of the EP&A Act.
My concerns include:

1. Noise Impacts – Non‑Compliance with NPI and Existing Conditions
2. Non‑Compliance with Existing Conditions (s4.55 Consideration)
3. Change in Use – From Food & Drink Premises to Nightclub‑Style Operation
4. Traffic, Pedestrian Safety, and Late‑Night Behaviour
5. Environmental and Amenity Impacts

A proponent who has not complied with existing conditions cannot reasonably be granted extended hours or intensification of use.

In a previous submission to the Shoalhaven Council in relation to extended trading hours at this venue the NSW Police acknowledge:
Extending the hours of operation will undoubtably result in an increase in noise disturbance for local residential areas.
The extended hours of operation will increase the risk of anti-social behaviour and alcohol related crime for the local and boarder community.
The local area is already lacking in the availability of public transport. With an increase late night patronage being on the street with increased level of intoxication and limited means of transportation from the area.
The increase in late night patronage spilling onto the local street will undoubtably increase complaints of noise disturbance and anti-social behaviour. Being a tourism sector, this could have an adverse impact on local residence and local businesses. As well as the increase in the required police response to the anticipated increase in anti-social behaviour and alcohol related violence.
The increase in trading hours would likely exacerbate the adverse impacts on the amenity of the local area and increase the likely hood of alcohol related violence.
The extended hours of operation will pose a significant risk to the safety and well-being of the local community.
It the non compliance of current conditions and objections from the local police command that I oppose this modification to the change in operating hours for both the “Beer Garden” and the “Waterfront Bar”.
