- This subdivision follows the approval by Council of development permit 2025/000216 to construct two new dwellings on the land. Accordingly, we request Council waive the requirements of Clause 56. The subject land is already affected by existing Owners corporation No.1 on PS836382V and this application seeks to modify the OC structure to allow for the creation of an additional OC which will be ‘limited to common property’ and for the sole use of the two dwellings under construction on the subject land. Our client would like the option of entering into a 173 agreement with council to link the approved development with the subdivision to allow council to issue SOC prior to the completion of construction, thus we request council includes an appropriate condition to allow this.
