Description

The proposed subdivision relates to the existing completed office building at 122 Moray Street, South Melbourne. The building has been constructed in accordance with the approved development permit and an Occupancy Permit has been issued within the preceding five years. Accordingly, it is considered that the proposed subdivision satisfies the requirements for a VicSmart application under Clause 59.02, being a subdivision of land into lots each containing an existing building or car parking space. The proposed Plan of Subdivision has been structured to separately title the existing office areas and associated car parking spaces where the intended ownership and tenancy arrangements are presently known. Where the ultimate tenancy configuration of an office floor has not yet been determined, the relevant portion of the existing building is proposed to be contained within a larger stage lot. This approach avoids prematurely establishing lot and common property boundaries before the final tenancy arrangements are known and provides flexibility for the future subdivision of those areas. All car parking spaces will be allocated to either a primary lot or a stage lot prior to the Plan of Subdivision being signed for Certification. Accordingly, there will be no unallocated car parking spaces shown on the Plan at the time of Certification. The final allocation of the car parking spaces will be confirmed once the ownership and tenancy arrangements for the building have been finalised. Any subsequent subdivision of a stage lot, including the creation of additional lots or common property, would be subject to a separate subdivision application and the relevant Council approvals applying at that time. The proposed stage lots therefore do not represent future or unconstructed development. Each stage lot comprises part of the existing completed building constructed pursuant to the approved development permit.
